Deteriorar el medi ambient produirà conseqüències negatives a les generacions futures, és un dels arguments més usuals esgrimits no només per ambientalistes, sinó també per diferents teòrics del dret que estan preocupats per la seva preservació. S’intenta analitzar si una reformulació de la tesi contrafàctica clàssica del dany pot explicar l’objecció existent en obrar de la generació present quan els seus actes afecten l’ambient i, en conseqüència, les generacions futures, fins i tot en els casos on l’acció que produeix el efecte nociu és, alhora, la causa de l’existència de l’ésser que es vol proteger

Deteriorating the environment will produce negative consequences for future generations, it is one of the most common arguments put forward not only by environmentalists, but also by different legal theorists who are concerned about its preservation. An attempt is made to analyze whether a reformulation of the classic counterfactual thesis of damage can explain the existing objection to acting on the part of the present generation when their actions affect the environment and, consequently, future generations, even in cases where the action that produces the harmful effect is, at the same time, the cause of the existence of the being that is to be protected
