Reliance upon policy-makers; the force of the experts and the claim of legitimacy

Es planteja la idea que –a diferència del que ha estat destacat per la teoria jurídica– de vegades, les normes socials es troben en competència o tensió amb les normes jurídiques i generen que aquestes últimes siguin ineficaces i/o inefectives. A partir d’aquest plantejament, i partint de l’exemple de la desigualtat de gènere com a cas paradigmàtic d’aquesta competència, es presentaran diferents combinacions d’interaccions funcionals i disfuncionals entre normes jurídiques i normes socials, i els resultats en termes d’eficàcia i efectivitat de les normes jurídiques. Com a reflexió final, s’exposarà breument la idea que la millora de l’eficàcia i l’efectivitat del dret requereix orientar l’atenció cap a processos que promoguin més racionalitat a l’activitat legislativa

The idea is raised that - unlike what has been highlighted by legal theory - sometimes social norms are in competition or tension with legal norms and cause the latter to be ineffective and/or ineffective. Based on this approach, and starting from the example of gender inequality as a paradigmatic case of this competition, different combinations of functional and dysfunctional interactions between legal norms and social norms will be presented, and the results in terms of ’efficiency and effectiveness of legal rules. As a final reflection, the idea that improving the efficiency and effectiveness of law requires directing attention towards processes that promote more rationality in legislative activity will be briefly presented
