Los poderes probatorios del juez y en específico el poder de incorporar prueba al proceso es un tema de amplia discusión. En Costa Rica la Reforma Procesal Civil realizó cambios importantes que afectan este poder. Este artículo expone como inciden esos cambios en la iniciativa probatoria del juez, cuáles son las críticas que comúnmente se realizan y si tienen un fundamento que permita concluir la improcedencia de este poder del juez The initiative of the judge to incorporate evidence in the process is a subject of wide discussion. In Costa Rica, the Civil Procedure Reform makes important changes that influence this initiative.
