La suspensió extraordinària de la pena de presó : Anàlisi doctrinal i jurisprudencial de l’article 80.3 del Codi Penal

Aquest treball té com a objecte principal l’estudi doctrinal i jurisprudencial sobre l’aplicació de l’article 80.3 del Codi Penal, això és, la suspensió extraordinària de la pena de presó. Es pretén albirar com els jutges i/o tribunals estan aplicant en la realitat aquesta modalitat excepcional de suspensió, oferint resposta a les següents preguntes d’investigació: Quins criteris, aspectes i/o variables segueixen els jutges i/o tribunals per valorar i decidir sobre la suspensió excepcional de la pena de presó? Com es vinculen aquestes decisions amb les diferents teories del càstig o models punitius actuals? Aquest treball ofereix un estudi teòric i pràctic complert per aprofundir en el coneixement de la realitat pràctica d’aquesta figura en el nostre Sistema de Justícia Penal

The present work focus on the doctrinal and jurisprudential study about the implementation of the article 80.3 of the Spanish code penal, that is, the extraordinary suspension of the prison sentence. Its aim is to judge how the judges and/or the courts are actually applying this exceptional modality of suspension, answering the following investigation questions: Which criteria, aspects and/or variables do the judges and/or courts follow in order to assess and decide about the exceptional suspension of prison sentence? How are these decisions linked to the different punishment theories or current punitive models? This work offers a full theoretical and practical study to go in depth in the knowledge of the practical reality of this figure in our Penal Justice System
