Incredibilidad subjetiva, persistencia y verosimilitud del testimonio en juicio

En este trabajo se analizan tres criterios de valoración del testimonio de víctimas y coimputados, recogidos como criterios vinculantes por la Corte Suprema de la República del Perú: Incredibilidad subjetiva o ausencia de motivos espurios, persistencia del relato en las diferentes etapas procesales y verosimilitud. Para ello, se recurre a la Psicología del Testimonio, pues es necesario explicar cómo funciona la memoria. Además, se evalúan las técnicas de litigación oral (interrogatorio y contraexamen) y su impacto en el proceso de recuperación del recuerdo. Finalmente, se brindan recomendaciones que permitirán mejorar la calidad del testimonio en juicio

In this work, three criteria for evaluating the testimony of victims and co-investigated are analyzed, established as binding criteria by the Supreme Court of the Republic of Peru: subjective unbelief or absence of spurious motives, persistence of the story in the different procedural stages and verisimilitude. For this, the Psychology of Testimony is used since it is necessary to explain how memory works. In addition, oral litigation techniques (interrogation and crossexamination) and their impact on the memory recovery process are evaluated. Finally, recommendations are provided that will permit the enhance of the testimonies quality in court
