El Tribunal del Jurado: Análisis doctrinal y a pie de juicio. Especial referencia al principio de no contaminación

" El principal objetivo del siguiente estudio se centra en la institución del Tribunal del Jurado en España, acometiendo el análisis desde una triple perspectiva: doctrinal, normativa y desde una visión práctica (i.e. acudiendo a distintos juicios por Jurado y entrevistando a profesionales del derecho de dicha figura). No hay una posición global unánime sobre la existencia del Jurado Popular, es decir, dispone tanto de numerosos detractores como de numerosas personas favorables a esta; ahora bien, la misma tiene una gran cantidad de motivos políticos para su existencia, como por ejemplo la participación ciudadana en la Administración de Justicia, pero no dispone de tantos motivos jurídicos. En los próximos epígrafes, se ofrecen los detalles de esta figura de gran trascendencia para nuestro sistema judicial y el análisis de la controversia sobre la imparcialidad (i.e. el principio de no contaminación) de los jurados. Más allá y brevemente, se dispone de una pincelada al nuevo Anteproyecto de la LECRIM 2020 y un pequeño estudio de derecho comparado. Por último, se ofrece un trabajo de campo respecto al Jurado mediante entrevistas a varios profesionales relacionados con dicha institución."

"The main aim of the following study focuses on the institution of the Jury Court in Spain, which approaches the subject from a triple perspective: doctrinal, normative and practical (i.e. attending various Jury Court trials and interviewing law professionals of the institution in question). There is no unanimous global position on the existence of the Jury Court, that is to say, there is a countless number as of detractors as of people in favor of it. However, it has a large number of political reasons for its existence, such as citizen participation in the Justice Administration, but it does not have as many legal reasons. Henceforth, the details of this figure of great importance for our judicial system and the analysis of the controversy over the impartiality (i.e. the principle of non-pollution) of the juries are offered. Further and briefly, there is a brushstroke of the LECRIM’s new draft 2020 and a small study of comparative law. Finally, fieldwork is offered regarding the Jury Court through interviews with several professionals related to this institution."
