La prueba grafotécnica: sus fundamentos, validez y fiabilidad

Últimamente mucha preocupación ha causado la incidencia de la prueba pericial respecto de las decisiones que se toman, esto dado la probabilidad de error que, tomada de forma acrítica, puede conllevar . En ese contexto, especial análisis exige la prueba grafotécnica, dado que ha sido recibida y utilizada acríticamente como una metodología válida y fiable. Es pues objeto de este trabajo analizar cuáles son los fundamentos empíricos de la prueba pericial grafotécnica; es decir, conocer cómo, de hecho, funcionan, abordar sus métodos y conocer si disponemos de información sobre su validez y fiabilidad. De esta forma, en el primer capítulo se abordarán las premisas de este estudio, para luego acercarnos a la prueba pericial grafotécnica; se revisará metodologías, técnicas y aquellas «leyes» en las cuales se sustenta dicha técnica; se establecerán los datos que nos otorga dicha técnica; finalmente, mediante la información recopilada se sostendrán varios criterios respecto de su admisibilidad.

Lately, much concern has been caused by the incidence of expert evidence regarding the decisions that are made, given the probability of error that, taken uncritically, can lead to. In this context, special analysis requires the graphotechnical test, given that it has been uncritically received and used as a valid and reliable methodology. It is therefore the object of this work to analyze what are the empirical foundations of the graphotechnical expert test; that is, to know how, in fact, they work, to approach their methods and to know if we have information about their validity and reliability. In this way, in the first chapter the premises of this study will be addressed, to then approach the graphotechnical expert test; methodologies, techniques and those "laws" on which said technique is based will be reviewed; The data provided by said technique will be established; Finally, through the information collected, several criteria will be supported regarding its admissibility.
