Una mirada processal a l’ocupació il·legal d’habitatges Especial referència al desnonament exprés i a les mesures de protecció a col·lectius vulnerables

L’objecte d’aquest treball és fer un estudi dels supòsits d’ocupació il·legal d’habitatges a Espanya i els diversos procediments jurisdiccionals contemplats a la Llei 1/2000, de 7 de gener, d’Enjudiciament Civil -en endavant LEC-; per donar-hi resposta. És per això que el treball es centrarà en l’estudi de la tutela sumària possessòria de l’habitatge, i es farà una breu referència al judici de desnonament per precari i al judici de protecció de drets reals inscrits, tenint en compte la reforma legal del 2018 de la LEC en relació al nou procediment civil de recuperació ràpida de la posició de l’article 250.1.4º LEC. Així mateix, s’incorporarà un anàlisi de les mesures adoptades, tan a nivell estatal com autonòmic català, per brindar protecció habitacional a col·lectius vulnerables, posant el focus d’atenció en la seva relació amb l’ocupació d’habitatges, que és l’objecte central del nostre treball

The main purpose of this thesis is to study the factual situation of illegal occupation of property in Spain, and the various jurisdictional procedures in Law 1/2000, January 7th, of Civil Procedure; to respond to illegal occupied housing. For that purpose, this thesis will be fucus on studying the interdict to regain possession of housing and a brief reference to the trail of eviction by precarious and the trail of protection of proprietary rights registered will be made, considering the legal reform in 2018 of the Law 1/2000, January 7th, in relation to the new civil procedure for fast recovery of possession of the Article 250.1.4º LEC. Moreover, an analysis of the measures adopted, both state and Catalan regional level, in the field of housing for vulnerable groups, focusing on occupation case, object of the thesis
