El problema probatorio de la mentira

En el trabajo se sostiene que la sinceridad forma parte necesaria de una condición compleja (i.e. se haya dado una percepción correcta, no existe distorsión de la memoria, y que el testigo cuente con un instrumental conceptual de interpretación del hecho percibido, así como la capacidad de describirlo) suficiente para afirmar la verdad de un enunciado fáctico, que contempla dentro de su justificación la declaración testimonial. Por ello, tiene por objetivos poner en evidencia la relevancia epistémica de la sinceridad y explorar el problema probatorio de la mentira como el principal obstáculo que presenta la cuestión anterior. Luego, se concluye que, al tratarse la mentira de una actividad intencional, parece que el único material con el que se cuenta para su evaluación, son las palabras que emite el testigo, por lo que el significado y el contexto se presenta como un camino posible para su demostración

This work defends that sincerity is a necessary part of a complex condition (i.e. given a correct perception, no memory distortion and sufficient conceptual instruments in the witness to both interpret the perceived fact and to describe it as well), condition itself sufficient to affirm the truth of a factual statement which contemplates within its justification the testimony. Therefore, its objectives are to highlight the epistemic relevance of sincerity and explore the evidential problem of lying as the main obstacle presented by the previous question. It is then concluded that, considering lying as an intentional activity, the only material available for its evaluation are the words emitted by the witness; therefore, the meaning and the context is presented as a possible path for its proof
