La preparación del testimonio: un falso mantra, cargado de riesgos epistémicos

Son muchos y muy serios los problemas que aquejan a la prueba testimonial. Si algo se deriva de los estudios de la psicología del testimonio es justamente ello. Por el carácter secreto en el que se realiza, por la limitada confrontación que al respecto puede adelantar la contraparte y porque implica una injerencia directa –al menos potencial– en el contenido del relato, la preparación del testigo es uno de esos problemas. Quizás uno de los más graves. Aunque un sector de la doctrina anglosajona y latinoamericana afirma a modo de máxima que los abogados deben preparar a los testigos, son pocos los esfuerzos rigurosos por precisar el concepto, sus límites y los riesgos que conlleva para la búsqueda de la verdad y los abogados que intervienen en el proceso. Este trabajo, a través “experimento epistémico” y de una propuesta de regulación detallada, constituye un primer esfuerzo por superar ese vacío

There are many and very serious problems affecting testimonial evidence. If anything comes from the studies of the psychology of testimony, is that. Because of the secret nature in which it is carried out, the limited confrontation that the adversary can bring forward and because it implies a direct influence -at least potential- in the content of the testimony, the preparation of the witness is one of those problems. It is perhaps the most serious. Although a sector of Anglo-Saxon and Latin American doctrine has affirmed as a maxim that lawyers must prepare witnesses, there are few rigorous efforts to concrete the concept, its limits and the risks it involves for the search of the truth and the lawyers trying the case. This work, through a “epistemic experiment” and a proposal to regulate the matter in a precise and detailed manner, constitutes a first effort to overcome this gap
