Fiabilidad como criterio de valoración de la cadena de custodia en el proceso penal

El trabajo tiene por objetivo abordar el papel de la cadena de custodia en el razonamiento probatorio, el criterio de fiabilidad y las implicaciones de su ruptura. Teniendo en cuenta el principio epistémico de inclusión y el hecho de que la violación de la cadena de custodia no se corresponde directamente con una violación de los derechos fundamentales del imputado, se postula que la ruptura de la cadena de custodia no implica automáticamente la inadmisibilidad de la prueba. En ese sentido, si bien no afecta el debido proceso legal, la ruptura reduce el “peso” de la prueba y exige un mayor esfuerzo argumentativo y probatorio de la parte que la aporta, lo que se analizará a la luz del acervo probatorio y del grado de violación de la cadena. Este estudio descriptivo utiliza datos bibliográficos y jurisprudenciales, ofreciendo enfoques conceptuales y teóricos con orientación práctica

The objective of this paper is to address the role of the chain of custody in evidentiary reasoning, the reliability criterion and the implications of its breaking. Considering the epistemic principle of inclusion and the fact that the violation of the chain of custody does not directly correspond to a violation of the fundamental rights of the accused, it is postulated that the rupture of the chain of custody does not automatically imply the inadmissibility of the evidence. In this sense, although it does not affect the due process of law, the rupture reduces the “weight” of the evidence and requires a greater argumentative and probationary effort from the party that provides it, which will be analyzed in light of the body of evidence and the degree of violation of the chain. This descriptive study uses bibliographic and jurisprudential data, offering conceptual and theoretical approaches with a practical orientation
