Drets i garanties de les víctimes del tràfic d’éssers humans en el procés penal a Espanya. Estudi i reflexió de l’Avantprojecte de Llei Orgànica Integral contra el tràfic i l’explotació d’éssers humans

This Final Degree Project (FDP) focuses on two large blocks. On the one hand, it focuses on the study of the rights of victims of human trafficking in criminal procedure in Spain, in addition to some problems that may have arisen, the outstanding jurisprudence or the comparison of theory with applied reality. We will see the different phases that a victim goes through from the moment of identification until the corresponding compensation is granted. On the other hand, with the desire that this project stands out for its topicality, I will carry out a complete and detailed analysis of the Draft Comprehensive Organic Law Against Trafficking and Exploitation of Human Beings as an impulse of Spain’s Government; which after falling in the previous legislature due to the call for elections, was approved this past March 8, 2024 by the Council of Ministers. A joint balance will therefore be made with the European regulations to prove if it is really a useful document or a political move by the Government, studying the new developments it provides with the help of the Report of the Regulatory Impact Analysis of this preliminary draft, published on April 20, 2024

El present Treball Final de Grau (TFG) es centra en dos grans blocs. D’una banda, ens centrarem en l’estudi dels drets de les víctimes del tràfic d’éssers humans dins el procés penal a Espanya, així com algunes problemàtiques que s’han pogut donar, jurisprudència destacada o comparació de la teoria amb la realitat aplicada. Veurem les diferents fases per les quals passa una víctima des del moment de la seva identificació fins que se li atorga la corresponent indemnització. D’altra banda, i complint amb la voluntat que el treball en qüestió destaqués per la seva actualitat, es farà un anàlisi complet i detallat de l’Avantprojecte de Llei Orgànica Integral Contra el Tràfic i l’Explotació d’Éssers Humans com a impuls del Govern d’Espanya; que després de recaure a l’anterior legislatura degut a la convocatòria d’eleccions, va ser aquest passat 8 de març de 2024 aprovat pel Consell de Ministres. Es farà, doncs, un balanç conjuntament amb la normativa europea de si realment es tracta d’un escrit innovador o bé d’una jugada política del Govern, estudiant processalment les novetats que aporta amb l’ajuda de la Memòria de l’Anàlisis d’Impacte Normatiu del present avantprojecte, publicat en dia 20 d’abril de 2024
