El procediment d’habeas corpus. Estudi doctrinal i jurisprudencial

Habeas corpus is provided for in art.17.4 of the Spanish Constitution which states that “The law shall regulate an habeas corpus procedure to produce the immediate judicial disposition of any person illegally detained”. However, later we will see that simply transferring the detainee to the judge is not enough, his hearing and appearance are necessary so that, in the substantive trial, the legality of the detention can be judged. In Spain, positive law has made a very limited delimitation of this figure, in fact, the concept of habeas corpus has been outlined, essentially, through constitutional jurisprudence. It is for this reason that the present work is not limited to presenting the legal regulation of habeas corpus, but rather carries out a jurisprudential and doctrinal study of this institution. It is mainly through the analysis of judgments that the consolidated constitutional doctrine in relation to the habeas corpus procedure will be determined

L’habeas corpus està previst en l’art.17.4 de la Constitució espanyola que disposa que “La llei regularà un procediment d’habeas corpus per produir la immediata posada a disposició judicial de tota persona detinguda il·legalment”. Tanmateix, més endavant veurem que amb el simple trasllat del detingut davant del jutge no n’hi ha suficient, és necessària la seva audiència i compareixença per tal que, en el judici de fons, es procedeixi a l’enjudiciament sobre la legalitat de la detenció. A Espanya, la llei positiva ha fet una delimitació molt escassa d’aquesta figura, de fet, el concepte d’habeas corpus s’ha anat perfilant, essencialment, a través de la jurisprudència constitucional. És per aquesta raó que el present treball no es limita a exposar la regulació jurídica de l’habeas corpus, sinó que duu a terme un estudi jurisprudencial i doctrinal d’aquesta institució. És principalment a través de l’anàlisi de sentències que s’acabarà determinant quina és la consolidada doctrina constitucional en relació amb el procediment d’habeas corpus
