De nuevo sobre el defecto del producto. Análisis del artículo 7 de la Directiva (UE) 2024/2853, de 23 de octubre de 2024, sobre responsabilidad por los daños causados por productos defectuosos

El DOUE de 8 de noviembre de 2024 publicó la nueva Directiva (UE) 2024/2853, del Parlamento Europeo y del Consejo, de 23 de octubre de 2024, sobre responsabilidad por los daños causados por productos defec- tuosos y por la que se deroga la anterior Directiva 85/374/CEE del Consejo. La noción de producto defectuoso se encuentra en el artículo 7 del nuevo texto legal. El nuevo precepto parte de una definición bastante parecida a la de la Directiva anterior, aunque introduce alguna modificación y amplía sustancialmente el número de circunstancias evaluables en la determinación del defecto para adaptarlo a los retos que presentan las nuevas tecnologías y, particularmente, los sistemas de inteligencia artificial. A partir de un análisis sistemático del nuevo texto normativo, este trabajo profundiza en la interpretación de los distintos elementos que componen la definición de producto defectuoso, sobre la base de las elaboraciones de la doctrina y la jurisprudencia europeas rela- tivas a la anterior Directiva de 1985 y los materiales prelegislativos que han servido de base al nuevo texto legal. Una primera idea fuerza es que si, como se afirma en el propio preámbulo (cdo. 2), el régimen que establece la Directi- va es un régimen de responsabilidad objetiva, la interpretación de la noción de defecto y de las circunstancias a considerar debe tender a hacerse conforme a criterios lo más objetivos posibles. También se sostiene que la definición de defecto, basada en el test de las expectativas de seguridad y de carácter normativo, es lo suficientemente amplia como para incluir las tres categorías clásicas de defecto y no impide tomar en consideración el llamado test de riesgoutilidad, a pesar de no estar expresamente contemplado entre las circunstancias enumeradas en el artículo 7. Este trabajo no aborda las reglas relativas a la prueba del defecto contenidas en los artículos 9 y 10 de la Directiva, cuyo análisis específico requeriría una profundidad y extensión semejantes

The Official Journal of the European Union (OJEU) of 8 November 2024 published the new Directive (EU) 2024/2853 of the European Parliament and of the Council of 23 October 2024 on liability for defective products and repealing Council Directive 85/374/EEC. The notion of a defective product is found in article 7 of the new Directive in similar terms to those provided by 1985 Directive. The new text introduces some modifications and expands substantially the number of circumstances considered in the assessment of the defect given the challenges posed by new technologies and, particularly, IA. Based on a systematic approach of the new regulatory text, this paper addresses the analysis of the elements that make up the definition of defective product. By doing this, it considers the European scholarship and case law developed within the framework of the former 1985 Directive and the existing pre-legislative materials with respect to the new text. A first key point says that, if, as stated in the preamble itself (n. 2), strict liability is the regime of liability provided by the Directive, the interpretation of the defect and the circumstances to be considered should be based on the most objective criteria. It is also sustained that the definition of defect, grounded on the safety expectations test, is broad enough to include the three classical categories of defect. Similarly, it also allows the risk-utility test to be included in the assessment, despite not being expressly mentioned among the circumstances listed in Article 7. This paper does not address rules of proof provided in articles 9 and 10 of the Directive, whose specific analysis would require similar scope and depth
