Dret comparat i dret de fam铆lia en el marc europeu

This paper firstly reviews the role of comparative law in the field of family law, and then links it with the case law of the ECtHR on Article 8 ECHR. As the court tackles conflicts involving the interests of individuals in a variety of situations, it tends to embark very often in a comparative analysis of the family law in force in a number of jurisdictions to ascertain the validity of the applicable laws and whether a margin of appreciation of the State exists. In addition, the court has deployed a dynamic interpretation of the convention to ensure that the rights recognized therein have a real and effective protection in a changing society. The similarities and differences in national legal systems, the awareness of possible common trends and the evolution of domestic legal systems, all helps to shape the obligations that the ECtHR derives from Article 8. Taking for granted that comparative law is the only possible methodology in order to construe the provisions of the convention, the only one providing for decisive arguments in its interpretation, easily justifies the criticisms of the legal scholarship that is challenging the developments brought about by the ECHR in the ambit of personal and family matters

Aquest treball repassa el paper del dret comparat en l鈥櫭爉bit del dret de fam铆lia i el connecta amb lajurisprud猫ncia del Tribunal Europeu de Drets Humans sobre l鈥檃rt. 8 del Conveni Europeu de DretsHumans. Aquest tribunal es troba davant de conflictes que enfronten els interessos individuals de personesimplicades en situacions molt diverses. Per aix貌, s鈥檈mbarca sovint en l鈥檈xamen comparat del dret vigent al鈥檋ora de donar una resposta sobre la validesa de la regulaci贸 jur铆dico-familiar aplicable i sobre quin 茅s elmarge d鈥檃preciaci贸 dels estats part. El TEDH ha desplegat per a aquesta tasca una interpretaci贸 din脿micadel conveni amb l鈥檕bjectiu d鈥檃ssegurar que els drets que hi s贸n reconeguts gaudeixen d鈥檜na protecci贸 real iefectiva en una societat canviant. Les semblances i difer猫ncies dels ordenaments nacionals, la possibilitatsde discernir tend猫ncies comuns i la pr貌pia evoluci贸 interna d鈥檃quells ordenaments, influeixen a l鈥檋ora dedonar o no un determinat abast a les obligacions que el TEDH deriva de l鈥檃rt. 8 CEDH. Amb tot,considerar el dret comparat com l鈥櫭簄ica metodologia possible, com la verdaderament decisiva per a lainterpretaci贸 del conveni, obre molts flancs a la cr铆tica de la doctrina reticent als desenvolupaments de lajurisprud猫ncia europea en mat猫ria de persona i fam铆lia
