Dret comparat i dret de família en el marc europeu

This paper firstly reviews the role of comparative law in the field of family law, and then links it with the case law of the ECtHR on Article 8 ECHR. As the court tackles conflicts involving the interests of individuals in a variety of situations, it tends to embark very often in a comparative analysis of the family law in force in a number of jurisdictions to ascertain the validity of the applicable laws and whether a margin of appreciation of the State exists. In addition, the court has deployed a dynamic interpretation of the convention to ensure that the rights recognized therein have a real and effective protection in a changing society. The similarities and differences in national legal systems, the awareness of possible common trends and the evolution of domestic legal systems, all helps to shape the obligations that the ECtHR derives from Article 8. Taking for granted that comparative law is the only possible methodology in order to construe the provisions of the convention, the only one providing for decisive arguments in its interpretation, easily justifies the criticisms of the legal scholarship that is challenging the developments brought about by the ECHR in the ambit of personal and family matters

Aquest treball repassa el paper del dret comparat en l’àmbit del dret de família i el connecta amb la jurisprudència del Tribunal Europeu de Drets Humans sobre l’art. 8 del Conveni Europeu de Drets Humans. Aquest tribunal es troba davant de conflictes que enfronten els interessos individuals de persones implicades en situacions molt diverses. Per això, s’embarca sovint en l’examen comparat del dret vigent a l’hora de donar una resposta sobre la validesa de la regulació jurídico-familiar aplicable i sobre quin és el marge d’apreciació dels estats part. El TEDH ha desplegat per a aquesta tasca una interpretació dinàmica del conveni amb l’objectiu d’assegurar que els drets que hi són reconeguts gaudeixen d’una protecció real i efectiva en una societat canviant. Les semblances i diferències dels ordenaments nacionals, la possibilitats de discernir tendències comuns i la pròpia evolució interna d’aquells ordenaments, influeixen a l’hora de donar o no un determinat abast a les obligacions que el TEDH deriva de l’art. 8 CEDH. Amb tot, considerar el dret comparat com l’única metodologia possible, com la verdaderament decisiva per a la interpretació del conveni, obre molts flancs a la crítica de la doctrina reticent als desenvolupaments de la jurisprudència europea en matèria de persona i família
