La función epistemológica del principio de inmediación en la prueba testimonial: ¿Garantía procesal?

Históricamente se ha sostenido que el principio de inmediación contribuye para la valoración de la prueba, en tanto el contacto directo le permitiría al juzgador determinar la sinceridad/mendacidad de los declarantes. Sin perjuicio de ello, ni la doctrina ni la jurisprudencia han explicitado cuáles son las razones que permitirían asumir tales postulados. La intención de este trabajo es: a) precisar cuáles son los argumentos que se esconden detrás de este pensamiento; b) determinar si realmente el juzgador tiene la capacidad de establecer la sinceridad/mendacidad del declarante en base a la inmediación. Finalmente, se demostrará que el principio de inmediación carece de la función epistemológica que se le atribuye

Throughout history it has been held that the principle of immediacy serves for the assessment of evidence, on the grounds that direct contact would allow the judge to determine the sincerity/mendacity of declarants. Notwithstanding this, neither the doctrine nor the jurisprudence have made explicit what are the reasons that would allow to assume such postulates. The purpose of this work is to: a) identify what are the arguments that hide behind this thought; b) determine if the judge really has the capacity to establish the sincerity / mendacity of the declarant based on immediacy. Finally, it will be shown that the principle of immediacy lacks the epistemological function attributed to it
