Precedente e inteligencia artificial: el impacto de los sistemas predictivos en la teoría del precedente y la práctica judicial

ENG- This PhD dissertation is located in a frontier between theory and philosophy of judicial precedent and Artificial Intelligence and Law (AI&L). It is divided in two parts. In the first part (chapters I to III) some of the main conceptual problems around the theory of judicial precedent (the concept, interpretation and constraining of precedents) are analyzed, with a special concern in giving an account of precedential phenomena in civil law legal systems. Thus, a redefinition of certain concepts common to the theory of precedent, such as ratio decidendi and stare decisis is proposed. Later, in chapter IV, I develop a general exposition on artificial intelligence and its application in the legal field, specifically with the purpose of give an account of AI-based models that are capable of representing past cases concerning the merits of the case, showing justificatory reasons, and making explicit the machine’s reasoning (CMLA, or computational models of legal argument). This is covered from the pioneer models (HYPO and CATO) to the current machine learning-based and generative IA-based models, with an emphasis in other approaches such as the one proposed by Horty, et al. In chapter V, the dissertation aims to enlighten some conceptual and philosophical problems around those models (the classification among justificative IA systems and predictive AI systems and the concept of “factor”) and, finally, in chapter VI, with a normative approach, I identify the necessary conditions for an AI model to be implemented as a legal assistant. With this basis, in a hypothetical implementation, I defend the proposition that an IA system would bring order to the jurisprudential chaos, that ratio decidendi would still have a special relevance but the methods for interpreting and applying it would change, and that a greater adherence to precedents would be promoted

CAT- Aquesta tesi doctoral es troba en una frontera entre la teoria i la filosofia del precedent judicial i la intel-ligència artificial i el dret (AI&L). Està dividida en dues parts. En la primera (capítols I a III) s’analitzen alguns dels principals problemes conceptuals al voltant de la teoria del precedent judicial (concepte de precedent, ratio decidendi i stare decisis), amb una especial preocupació per donar compte dels fenòmens del precedent en els sistemes de civil law, optant per una clarificació de certs conceptes propis de la teoria del precedent. Posteriorment, al capítol IV, es realitza una exposició general sobre intel-ligència artificial (IA) i la seva aplicació en el dret, específicament per donar compte dels sistemes basats en IA capaços de representar precedents tenint en consideració el mèrit del cas, oferint raons justificatives i explicant els seus raonaments (CMLA, o computational model of legal argument). Es cobreix des dels sistemes precursors (HYPO i CATO) fins als sistemes actuals basats en machine learning i IA generativa, amb èmfasi en altres aproximacions proposades per Horty i altres. Al capítol V, la tesi passa a destacar alguns problemes conceptuals i filosòfics al voltant d’aquests sistemes (classificació de sistemes d’IA en justificatius i predictius i el concepte de “factor”) i, finalment, al capítol VI, de tall normatiu, s’identifiquen els requisits necessaris d’un sistema d’IA que treballi amb precedents perquè pugui ser implementat com a assistent legal. A partir d’això, davant una eventual implementació, es defensa que un sistema d’IA podria portar ordre al caos jurisprudencial, que la ratio decidendi continuaria sent rellevant però que es modificarien els mètodes per interpretar-la i aplicar-la, i que es promouria una major adhesió als precedents
